~ In a move to hold the Biden-Harris Administration accountable for their open border policies, Governor Greg Abbott has issued an Executive Order directing the Texas Health and Human Services Commission (HHSC) to collect and report information on healthcare costs incurred by illegal immigrants in Texas. The order also requires HHSC to report these costs annually to the Governor and Texas Legislature so that the state can seek reimbursement from the federal government.
According to Governor Abbott, the reckless open border policies of President Joe Biden and Vice President Kamala Harris have resulted in Texas having to bear the financial burden of providing medical care for individuals who are in the state illegally. He believes that Texans should not have to shoulder this responsibility and is taking action to ensure that the federal government is held accountable for their actions.

Under this Executive Order, HHSC will immediately begin directing hospitals and other identified providers to collect information on the cost of medical care provided to illegal immigrants. This process will begin by November 1, 2024. The covered hospitals will then be required to report this data quarterly to HHSC, with initial submissions due by March 1, 2025.
In addition, hospitals will be directed to inform patients that responding to these questions about their immigration status will not affect their care. This is in accordance with federal law.
Starting on January 1, 2026, HHSC will also be required to report annually on the previous year's costs for medical care provided to illegal immigrants. This information will be shared with the Governor, Lieutenant Governor, and Speaker of the House.
